Contents of SVBS Course: Criminal Procedure

This module teaches the constitutional and other protections extended to individuals facing criminal charges in the U.S. Topics covered include searches and seizures, warrants, Miranda rights and the defendant's rights to representation by legal counsel.

Learning Objectives and Outcomes

Upon completion of this course you will be able to:

Explain how the U.S. Constitution provides rights to individuals facing criminal charges via the 4th, 5th and 6th Constitutional amendments.
Describe the scope of an individual's Constitutional rights against unreasonable searches, arrests and seizures in the U.S.
Advise an individual on his/her right to legal counsel and representation when accused or charged with a criminal offense.

  • Central to the rule of law is a fair and impartial arbiter, the judge, who makes decisions based on the law and not personal prejudices, political considerations, or what may be popular at the moment. Yet, as this video explores, people who become judges may have biases that influence their decisions. There is a particular danger of political considerations influencing judicial decisions in states where judges are elected.

  • A criminal defendant's right to an attorney is found in the Sixth Amendment to the U.S. Constitution, which requires the "assistance of counsel" for the accused "in all criminal prosecutions".

  • What the Sixth Amendment Guarantees
  • The Sixth Amendment guarantees the right to legal counsel at all significant stages of a criminal proceeding. This right is so important that there is an associated right given to people who are unable to pay for legal assistance, to have counsel appointed and paid for by the government. The federal criminal justice system and all states have procedures for appointing counsel for indigent defendants.
